DAVID W. WOODWARD
David Woodward has been a patent attorney, procuring patents and counseling clients, for more than 25 years. As a former Examiner at the USPTO, David developed an appreciation of what approaches can be helpful to Examiners (and which are not) in prosecuting patent applications. As such, David is well-positioned to drafting new patent applications to ensure that they are in the best condition for examination in the PTO.
Through David’s extensive experience, he has developed excellent relationships and rapport with PTO Examiners. He prides himself on working and negotiating with Examiners to achieve beneficial results for his clients. David takes advantage of the various procedures available within the Patent Office, including interviewing cases (often with inventors and applicants participation), and when appropriate, their supervisors, to achieve commercially beneficial results for clients.
David prides himself on being very responsive to client communications. He works closely with clients to understand their industry, their technology, and their business goals, whether drafting or prosecuting a patent or advising on freedom of operation, patent validity, invention patentability, infringement issues, or other IP due diligence matters. He takes care to understand the pertinent facts and legal issues and providing clients with the necessary work product in a clear, concise and timely manner. For example, when working on due diligence and deals for clients, David expeditiously reviews numerous documents to uncover which issues may be most pertinent to the deal.
When working with clients and the Patent Offices, David can simplify complex technology and legal principles and separate the wheat from the chaff in a way to achieve clear work product and desired results for clients.
Should an appeal at the PTO be necessary, David has extensive experience drafting appeal briefs and conducting oral arguments before the U.S. Patent Trial and Appeal Board. Once a patent has granted, David also handles post-grant procedures, including reexamination, reissue, inter partes reviews (IPR) and post grant reviews (PGR).
David previously was a partner in a large firm working on chemical and pharmaceutical patent litigation matters. This litigation experience where patents and their prosecution histories are put under a microscope for possible challenges, guides David in advising, drafting, and prosecuting patents for clients.
David has a strong legal background, graduating first from his class at George Washington University Law School. A strong analytical and legal background provides David with the necessary tools to obtain desired results for companies. David received Chemical Engineering and Chemistry degrees from Virginia Tech in 1986 and works with clients in the chemical, materials, and engineering fields.
David was born and raised in Buffalo New York and is married and a father to three college-aged children. He likes to spend his free time attending sporting events (Go Bills), trying out new restaurants (and then hopefully hitting the gym), and spending time with his kids.
